Austin police to release video that appears to contradict attorneys' account of ICE shooting of Wilber Rafael Garces Perez

Austin police are preparing to release video evidence that may challenge the narrative presented by attorneys representing Wilber Rafael Garces Perez, who was shot by an ICE officer on September 20. The shooting has ignited a political firestorm, with Congressman Greg Casar calling for ICE's removal from the city.

Garces Perez was shot once in the torso and initially hospitalized in serious but stable condition. He was later transferred into ICE custody, only to return to the hospital before being taken back to detention. His attorney, Kate Lincoln-Goldfinch, reported that he still has a bullet lodged in his body and is experiencing significant pain.

“He is in a lot of pain,” Lincoln-Goldfinch stated, highlighting the severity of Garces Perez's condition. In response to the incident, a federal judge has granted an emergency order to temporarily halt Garces Perez's deportation, and a lawsuit has been filed on his behalf.

The Department of Homeland Security (DHS) has defended ICE's actions, with Secretary Markwayne Mullin asserting that ICE agents have apprehended dangerous criminals in Texas. He stated, “DHS will NEVER apologize for removing these criminals from our communities, because deporting illegal aliens saves lives.” The upcoming video release by the Austin Police Department is anticipated to provide further clarity on the events surrounding the shooting.

The department is scheduled to hold a press conference at 3:30 p.m. Tuesday to discuss the investigation and release relevant materials.
