The Kuala Lumpur High Court has ordered Rosmah Mansor to pay RM67.46 million to Lebanese jeweller Global Royalty Trading SAL into a joint stakeholder account within a month, pending her appeal regarding 43 pieces of jewellery not returned to the jeweller.12
Judicial Commissioner Marianne Antoinette Ghani granted the conditional stay, emphasizing that it balances the rights of both parties involved. She stated, "In the circumstances, the court orders that a conditional stay of execution be granted to the defendant pending her appeal to the Court of Appeal."
The court found that a conditional stay requiring the defendant to pay the judgment sum into a joint stakeholder account would best balance both parties’ rights. "This will ensure that the plaintiff as the successful litigant is assured the fruit of its successful litigation and avoid the prejudice caused by an unconditional stay if the appeal is dismissed," she added.
Rosmah had previously argued that Global Royalty was a foreign entity with no business presence in Malaysia, which could risk the judgment sum being transferred out of the jurisdiction. The case revolves around 44 pieces of luxury jewellery worth RM67,461,027.37 (approximately US$14.57 million) that were delivered to Rosmah in 2018 under a consignment arrangement but were never returned following a police raid.35
