Federal court strikes down decades-old firearms restrictions as unconstitutional; gun rights groups capitalize, calling it 'Monumental'

A federal court ruling has overturned decades-old firearms restrictions, marking a significant victory for gun rights advocates.

The U.S. District Judge James Wesley Hendrix ruled that the National Firearms Act's (NFA) registration and approval requirements were unconstitutional after Congress eliminated the associated taxes.¹⁴

Gun Owners of America (GOA) and other groups quickly moved to capitalize on this ruling, allowing the transfer of gun silencers without the previously required federal registration for the first time since 1934.²³⁶

“This is the first time in 92 years that any gun owner has been able to do this,” said Aidan Johnston, GOA’s director of federal affairs.

The ruling stems from a legal challenge initiated by GOA and the Silencer Shop Foundation, which argued that the NFA's requirements could no longer stand after Congress reduced the tax on suppressors to $0.

Rep. Andrew Clyde, R-Ga., who supported the legislation leading to the ruling, called it “literally, the greatest win in the history of our country.”

While the court did not issue a nationwide injunction, it permanently blocked federal officials from enforcing the challenged requirements against the plaintiffs and their members.

“Efforts to render the NFA constitutional must come from Congress, not this Court,” Hendrix stated, emphasizing the need for legislative action to address the remaining regulations.

This ruling is seen as a pivotal moment in the ongoing debate over gun rights and regulations in the United States.
