The Delhi High Court has lifted the restraint imposed by a New Delhi commercial court on Fox Mandal & Associates from using the 'FoxMandal' trademark, following a consent agreement between the disputing parties.
The trademark dispute arose when Somabrata Mandal and his firm, Fox Mandal & Co, claimed ownership of the 'FOXMANDAL' trademark, which they registered in 2002. They asserted that the firm was originally established by their late father, Dinabandhu Mandal, in 1984, with Somabrata becoming Managing Partner in 1989 and personally designing the logo.
Earlier, on May 2, the commercial court had restrained Shuvabrata and Shouryabrata Mandal and their firm Fox Mandal & Associates from using the 'FoxMandal' trademark and the associated domain. The plaintiffs alleged that the defendants registered the domain in 2010 without their knowledge but only began using it in 2018.
"The Delhi High Court on Wednesday set aside the restraint from using the trademark ‘FoxMandal’ in any form. The order was passed after obtaining consent from both parties," highlighting the resolution of the dispute.
This case underscores the complexities of trademark ownership within family-run firms and the importance of clear registration and usage rights to avoid legal conflicts.
